After this tragedy that struck Lorca (Murcia), in which we can only show our support for its people and lament the loss of life that has behaved, I would like to share this information with these in case they can be helpful, is a statement of legal aspect but can have many nuances and not to qu empunta being responsible or not, I say this because I will not be responsible for anything in case someone follow this path and then the thing does not work out and over me the load ... example let a guide only as a humble assistance:
The Lorca earthquake affected are entitled to take part to the Compensation Consortium safe as long as they pay a share of home insurance for this organism (usually included)
The Insurance Compensation Consortium as public company, with legal personality, covers the so-called "Extraordinary Risks" in Spain. This is provided in the Legal Status of the Consortium, approved by Law 21/1990 of 19 December, and that is reflected in the revised text approved by Royal Decree Law 7 / 2004 of 29 October, with modifications introduced by Law 12/2006 of 16 May, rules that define which events are considered extraordinary risks.
All policies are issued in Spain to cover property damage, including life and accident insurance policies on people, is necessarily included the extraordinary risks coverage by the Consortium. This way if there is a special risk, such as the earthquake that has suffered unfortunate people of Lorca and his environment, are entitled to claim from the Consortium and the latter will be to indemnify.
The compensation should include both the direct material damage, understood as the destruction or damage to insured property as a direct result of the event causes, including loss of profits, a result of direct damage, if it were covered by the ordinary policy. In addition, additional costs are compensated (desembarre, sludge removal, demolition, rubble removal, transport to landfill), but always limited to 4% of the sum insured.
The Consortium will manage claims processing applications for compensation received, assessing the damage by a team of experts appointed for this and paying compensation to affected policyholders.
Damage Consortium may be communicated to affected directly by the insured by the insurer or insurance agent or mediator. The fastest and easiest way would be communicating this information through the Call Center Consortium (902,222,665) between 9 pm and 18 pm, or online through Web Consortium ( www.consorseguros.es ), if available certificate or electronic DNI.
